Amy J. Benjamin

Ms. Benjamin’s practice focuses on intellectual property law including trademark, copyright, unfair competition litigation, counseling and procurement, and advertising law. She has considerable experience with Internet, new media, and on-line matters such as key word and pop-up advertising and domain name issues. Ms. Benjamin manages significant U.S. and foreign trademark portfolios, providing prosecution, clearance opinions and counseling services to her clients. She is also experienced in advertising and packaging review, licensing, and due diligence for corporate matters.

Ms. Benjamin received her J.D. in 1989 from New York University School of Law, where she had a fellowship in Libel Law. She received a B.A. in American Studies, cum laude, from Brandeis University in 1986.

Ms. Benjamin is actively involved in the American Bar Association Intellectual Property Law Section and the New York City Bar Association, where she has held various committee, board, council, and division chair positions. She is also a member of the New York Intellectual Property Law Association, the American Intellectual Property Association, and the International Trademark Association.

Ms. Benjamin frequently speaks and writes on intellectual property issues and has been published in the National Law Journal, the Licensing Journal, Metropolitan Corporate Counsel, Bright Ideas and Euro Watch. On behalf of the American Property Law Association, she authored an amicus brief filed with the United States Supreme Court in Metro-Goldwyn-Mayer Studios, Inc. v. Grokster, Ltd.

Ms. Benjamin is admitted to the courts of the State of New York, the United States District Court for the Southern, Eastern and Northern Districts of New York and the Eastern District of Michigan, and the United States Court of Appeals for the Second, Ninth and Federal Circuits.

Prior to forming Benjamin Law PC, Ms. Benjamin was a partner at Darby & Darby PC, an intellectual property boutique and an associate in the intellectual property group of Skadden, Arps, Slate, Meagher & Flom.

Ms. Benjamin was named as a New York Super Lawyer in intellectual property in 2006 and 2010 through 2021. She was recently named to the New York Metro Top Women Lawyers for 2022.
